Heres How NYs Historic New Sexual Harassment Laws Will Affect You

Heres How NYs Historic New Sexual Harassment Laws Will Affect You As the MeToo Movement gained momentum in 2018, New York joined California, Connecticut and Maine as the fourth state requiring geschftslebenes to train employees to prevent harassment. But they didnt stop there. The new legislation includes substantial new requirements for employers, and youre about to start noticing.Starting October 9, every employer in New York will need to update or adopt a sexual harassment policy, and by January 1, every employee in New York will need to receive sexual harassment prevention training.Thenew lawchanges the ways employers prevent and address workplace harassment, including any type of bias on the basis of sex sexual harassment, sex stereotyping, harassment on the basis of gender identity (including being transgender) or pregnancy, in addition to quid pro quo harassment when a person in authority trades, or tries to trade, job benefits for sexual favors. Some of the most profound chan ges address mandatory arbitration and non-disclosure agreements. With narrow exceptions, employers cannot require that sexual harassment claims go to arbitration, a forum that lacks the protections of bringing a claim in court. The new law also prohibits nondisclosure agreements unless the person bringing the claim wants one, making it easier for claimants to speak about their experience and harder for businesses to keep harassment allegations hidden. And if a company has, or bids on, a contract to provide goods or services to the State of New York, theyll need to prove that they have a policy and training regimen that complies with the law.Expect to see a number of changes in your workplace (or get ready, if youre responsible for implementing them), especially if attention to sexual harassment has not been a priorityGreater coverage for non-employees who experience harassment, and effort by employers to address harassment committed by non-employeesIts no longer good enough for an e mployer to say its not my problem, or I dont control the customer. Instead, employers have to address harassment committed by employees and third-parties, including vendors, building security, clients, customers, visitors, interns or others. Additionally, employers need to protect non-employees in the workplace from harassment, including contractors, subcontractors, temporary workers, vendors, consultants, interns or others providing services in the workplace.Youll receive a new sexual harassment prevention policyUpdated or new policies will explain how to report harassment internally and include a complaint fasson to use, as well as what government agencies you can make a report to. Youll know how your employer investigates complaints, and if youre a supervisor, what your additional responsibilities are when you know about harassment. Youll know all this because youll receive a copy of it in writing. Non-employee workers who are covered by a new sexual harassment prevention policy will receive a copy as well.If youre a supervisor or manager, you may havenew responsibilitiesSupervisors and managers must report any harassment that they observe or know of, even if no one objects to the harassment, and the new policy sanctions these personnel who knowingly allow harassment to continue. Supervisors and managers are crucial in building a workplace culture that doesnt tolerate harassment, so knowing how to handle a complaint and what your responsibilities are will have an outsized impact on preventing harassment.Every employee will be trainedBy January 1, 2019, every employee in New York State must receive an interactive training on how to prevent and address workplace sexual harassment, including what rights and remedies exist for victims and the responsibilities for supervisors. Ideally, this will be an in-person training and not just a check-the-box exercise to avoid legal liability.Workers can and should hold their employers to task on the new requirements. Re ad your new policy and understand it. Ask questions if youre not sure about something. Get clear on how your business is really going to prevent retaliation. Check out the model resources on the New York State website. If youre a supervisor, demand to get what you need to handle complaints properly. If youre a business owner, give the effort your vocal support and then put in the resources the business needs towards accountability for preventing harassment in the workplace. This new law benefits more than potential harassment victims if employers and managers seize this opportunity, they win too. Businesses that tolerate harassment lose productivity from workers distracted by avoiding a harasser, face reduced workplace morale, lose good people who get fed up and quit, and take a major reputational hit when workers tell their stories. And all of that is before a lawsuit.New York has set out to create a new standard in workplace protections, with the hope that new norms will be establ ished in its workplaces. If standards developed here have a positive effect, there will be good reason to see these standards adopted elsewhere. Its not possible to legislate workplace culture, but New Yorks aim is to encourage workplace cultures that support the reporting of harassment. MeToo and New York have given New York businesses an opportunity to increase productivity and support inclusive workplaces at the same time. It is up to the people who ansturm these businesses to seize the moment.--Audrey Roofeh leads Mariana Strategies LLC, an employment law consulting firm. Her work focuses on building effective harassment prevention programs for businesses.

How to Rise Above the Competition

How to Rise Above the CompetitionHow to Rise Above the CompetitionTactics for executive job seekers on how to rise above the nations growing talent pool.Business sucks.Layoffs abound.Job stability is wavering. Will you panic or prosper? If you want to accomplish the latter, remember this three-word philosophy Anonymity is bankruptcy.Thats why were going to explore three tactics for elevating your visibilityExert your distinctiveness.Prepare to be vulnerable.Be smart, leid a smarty-pants.When executed consistently, these practices will capture the attention of potential employers, thus contributing to a greater awareness of the value you bring to the company.1. Exert your distinctiveness. As an executive, the net worth of your menschenfreundlich capital is a function of your expertise. So, the three questions you need to ask yourself areWhat are you known for knowing?Who is already attracted to you and sees you as a resource? What have you done, specifically in the last 24 hours to amp lify that expertise within your company?Once youve identified and evaluated your true expertise and inventoried your negotiable personal assets, the next challenge is to assert that distinctiveness in every possible personal-branding touchpoint questions you ask, answers you give, e-mails you write, meetings you attend and conversations you hold. The cool part is, asserting your distinctiveness elevates your visibility. Elevating your visibility attracts more responsibility. More responsibly increases the net worth of your human capital. And an increased net worth of human capital compels potential employers and solidifies your job security.Remember If your presence makes a difference, your absence will make a different. You want people to start asking where you are when youre not around. You want to become so invaluable that you become noticeable in your absence. Executives like that get hired and rarely get laid off. What are you known for? What are you known as? And what hard-to-c opy capabilities do you possess that position you distinctively, effectively and continuously?2. Prepare to be vulnerable.Vulnerability is attractive. Vulnerability is approachable. Vulnerability is strength. Even President Obama during his first month in office recently owned up to the media for his poor appointee choice.Ive got to own up to my mistake, Obama told NBC News. Im frustrated with myself, with our team. Im here on television saying I screwed up.Look, were all a bit nervous. And were all a bit vulnerable. The danger is when were not willing to disclose that vulnerability by practicing radical honesty. So here is my suggestion Dare to be dumb.In my workshops and seminars, I challenge people to increase their usage of the phrase I dont know. It cuts down on the pressure to know everything. Plus, pretending like you do know when you dont cracks your foundation, your integrity. Its a falsehood in your personality, and during interviews employers can smell it. Being vulnerab le, however, means being secure enough to be who you are, even if who you are is wrong. Whats more, in a sea of gargantuan professional egos, your vulnerability will stand out as a refreshing change. Are you willing to admit your ignorance? Are you someone others can feel dumb in front of?Remember When you maintain this attitude of approachability, your employees and your potential employers will respond to (and have more respect for) you. How are you branding your honesty? Are you willing to take the lead with your integrity and become someone others can be vulnerable in front of?3. Be smart, not a smarty-pants.Yes, human capital is a function of knowledge. At the same time, theres a fine line between being smart, and being a smarty-pants.Heres the difference Smart people attract others smarty-pants people alienate others. Smart people are trusted with greater responsibility smarty-pants people are avoided.Next time you attend a department meeting, consider this three-step, unforge ttable strategyBite your tongue. Dont say anything until the last five minutes of the meeting. That way you can collect you thoughts, clarify your position and speak confidently. By looking around, listening and learning first, your comment will contain its maximum amount of brilliance.Come out of nowhere. When the meeting leader says, Does anybody have any questions? or Any final thoughts before we finish? you raise your hand and say I had an observation All the people in the room will turn their heads, rotate their chairs and look in the direction of the one person who hasnt said anything all morning you.Articulate your idea. This is the best part. See, if you only say one thing, it becomes more profound because scarcity creates a perception of value. Whats more, the longer you wait to say something, the more everybody else will want to know what youre thinking. Ultimately, your calmness, patience and quietude will draw them in. In the words of our mistake-friendly president, P ower grows through prudent use.Remember Let go of the need to prove how smart you are by always adding some super-intelligent comment or asking some super-tricky question. You can still be smart and be perceived as being smart without looking like a know-it-all jerk. Are you sharing your knowledge or showcasing it? Are trying to elevate your visibility or be the center of attention?Look, times are tough tougher than theyve been in a long time. But youre tougher. And Im confident youre going to make it out aliveChallenge Pick a few of the strategies from this list that work best for you. Customize your visibility plan according to your unique skills and passions. And remember those three crucial words Anonymity is bankruptcy.Let me ask ya this How are you elevating your visibility?Let me suggest this For the list called, 30 Ways to become the Most Interesting Person You Know, send an e-mail to me, and Ill send you the complimentary list

2 Things to Consider Before Disagreeing With Your Boss - The Muse

2 Things to Consider Before Disagreeing With Your Boss - The Muse2 Things to Consider Before Disagreeing With Your BossImagine this Your boss announces a new plan to reorganize the office, specifically, wzu siche people sit and work, to improve collaboration and work flow among team members. You listen as she talks, but the more you hear, the worse you think her idea is. As you nod your head, your brain is screaming This will grind work to a halt I wont be able to focus in a completely open space next to my chattiest colleagues So, what do you do Do you tell your supervisor you disagree or let it slide? No one wants to get on the boss bad side, but there are worse things than speaking up. Like, bedrngnis speaking up at all when you know your boss is about to make a fool of himself because he didnt have all the facts. Almost every boss-employee relationship is influenced by a set of unspoken, unwritten agreements. One of the strongest for managers is this one I will never fault my emp loyee for correcting me if doing so keeps me from looking stupid to my boss. Learning to disagree with your superior without insulting him or her is among the most important job skills youll ever learn. In fact, it might even get you promoted Its just important to keep these two things in mind before you do it1. Take Ego Out of the EquationIts important to make a distinction between when you disagree with your boss because he or she doesnt have all of the facts or because its a matter of opinion. If hes an expert on the subject and youre not, dont lead by saying you disagree. Instead, ask your supervisor to explain his thinking. First, this shows that you allow for the possibility that its your lack of knowledge at play. Second, you may learn something new. And third, if you still disagree, at least youll have all of the information.Say you fall into that third category its purely a matter of opinion, but youre still certain your way is better. How should you proceed? To start, ask yourself Is disagreeing about this worth it? If it doesnt influence you, wont make your boss look stupid, or wont do harm to anyone (most especially the customer) let it slide. For example, even if you think you shouldnt serve the exact same lunch at every board meeting, the board members arent coming for the food, so its not the end of the world. 2. Consider the ConsequencesBut sometimes, letting it slide isnt an option. (For example, if your boss suggests cutting a small aspect of your program- that you know is much-loved by clients.) departure by asking open-ended questions. Try Would you be open to a suggestion for a different way to approach this? or simpler still Can I toss out a different idea? If he or she says, no, let it go. Its a good indication that he or she wouldnt be receptive to your approach anyhow. Its also important to weigh the consequences of what will happen if you dont speak up. The more serious the consequence, the more important it is for you to be adamant an d willing to risk over-stepping.Begin by explaining your intentions and then share your opinion. I once watched a friend who was a project manager on a big job with millions of dollars at stake patiently (and repeatedly) explain to her client that if they didnt do something the way she was suggesting, her client risked losing a lot of money. She started with I make it a rule to not disagree with my clients unless I know theyre suggesting something that will cost them more than they want to spend- this is one of those times. From there, she shared her opinion. You could take this same approach with your boss if you foresaw consequences to her proposed plan. Finally, dont think that the facts of an argument will speak for themselves- they rarely do. Decisions and disagreements are human actions and are therefore always subject to human emotions. You dont have to sing Kumbaya or try to be overly nice, but its important to take emotions and feelings into account when youre disagreeing wi th someone, especially if that person happens to be your boss. Recruitment Strategies to Expand your Small Business Hiring

Recruitment Strategies to Expand your Small Business HiringRecruitment Strategies to Expand your Small Business HiringRecruitment Strategies to Expand your Small Business Hiring Rossheim, Senior Contributing WriterYour business somehow weathered the devastating economic recession youveseen your business grow. Your hard-working team is doing double duty and youve made a point to prioritize employee motivationyet your people may be nearing a breaking point as the workload mounts. Your credit line cant be counted on as banks continue to tighten the reins on lending. What do you need to do?Make an employee recruitment strategy for next month, next year and well into the future. And make that plan right now.If you dont yet have a plan for bringing on more workers, youre certainly not alone. Most small businesses dont seem to have a hiring plan, says Roberta Matuson, president of consulting firm Human Resource Solutions in Northampton, Mass. But if you want to keep ahead of the competition , departure planning your headcount increase today - even if you dont anticipate adding to your payroll for quite a while. To get you started, here are four factors to consider in the recruiting and hiringprocess.Plan employee recruitment to serve your evolving marketWith shrewd moves and good luck, your business will grow in the coming months and years. So its time to start plotting the skills mix and bandwidth that youll need to handle your companys next phase. Lots of small companies arent dealing with the challenge of their business increasing, says Matuson. These businesses arent hiring theyre just asking their people to do more. But you can only do that for so long before people are exhausted and say, Im done. Your clients, like fruchtwein American businesses and individuals, are pressing harder than ever to receive top value. That means youll have to serve new needs economically, with a lean labor force thats totenstill up to the task. As markets change, you need to plan for where youre going to get the necessary skills, says Matt Rivera, director of customer solutions at staffing firm Yoh.Before you hire, show yourself the moneyIt used to be that small businesses could borrow for a few months to cover the financial gap between a payroll increase and the receipt of additional revenue produced by those new employees. But thats changed in the draconian credit environment of the 2010s. The simplest and safest approach If you dont have the cash flow, then you probably shouldnt be doing it, says John Millikin, a professor at the W.P. Carey School of Business at Arizona State University.Never forget that todays cash-cow customer could be tomorrows former client. Things happen in business, says Patty Barry, a principal at public relations firm Matter Communications in Newburyport, Mass. So we dont hire until we have the revenue to support it.Allow time for hires to come aboard and get productiveApplicants are plentiful in these times, but candidates who meet your criteria wont necessarily be quick to come by. Were having a hard time finding people in the sweet spot of four to five years of experience, says Barry. We certainly have a lot of interest in the company, but its still not easy to get the right people.Remember to build in time for the onboarding process even skilled workers who are skilled learners dont reach their full potential in a matter of days. It probably takes 6 to 12 months to get a salesperson up to speed, says Tim Slattery, CEO of Corporate Fulfillment Systems, a marketing services firm in Norton, Mass. Also keep in mind that, if you maintain high standards on the job, you may need to terminate the employee. On the production floor, we probably go through eight or 10 people to finder a keeper, says Slattery. Many dont like what theyre doing or arent a good fit for us. Thats why we hire temp-to-perm and make a decision on a hire after three months.Beware of disruptions as you grow your staffPerhaps the most subtle grow th challenge is to add staff while keeping clients happy and maintaining the company culturethat made you successful. People hire quickly because they want a warm body, says Jennifer Thompson, a professor at the Chicago School of Professional Psychology. When you bring in someone whos a difficult employee, the higher performers dont like it. One person has a large impact on a small workplace.Matter Communications maintains good client relations by avoiding switching them from an experienced account executive to a new hire. Our goal is to onboard employees onto new teams for new clients, or onto teams that already have a great relationship with a client, says Barry.
